PRIVACY POLICY

This Privacy Policy (this "Policy") describes the types of personally identifiable information ("Personal Information") ClearVoice, Inc., its affiliates, and each of their respective successors and assigns (collectively, "we" or "our") collect from you ("you" or "your") or that you provide when (i) you use the services provided by us through means other than the Platform (the "Services"), (ii) you access our website at www.clearvoice.com or any other web site or IP address designated by us (the "Site"), or (iii) you post entries or otherwise provide information to or through our blog accessible at www.clearvoice.com/resources/ (collectively, the "Platform") and our practices for processing personal information.

This Policy applies to Personal Information we collect through the Platform and the Services and in email email, text, and other electronic messages between you and the Platform. Please note, this Policy does not apply to any information that you may provide to third-party services, for example, other websites that are linked to our platform. Any information you may choose to share with such third parties will be subject to their terms of use and privacy policy that we encourage you to read and make sure you understand and agree with before sharing your information.

By using the Platform and/or the Services, you acknowledge that you have read and understand the terms of this Policy which is governed by our Terms of Service, also available on our Site.

1. Information We Collect and Store. We collect and store the following Personal Information when you are using the Services or the Platform:

A. Information You Provide. When you register for, or access to the Platform or the Services, we collect Personal Information, such as your name, phone number, email address, and home and business postal addresses. If you are a freelancer, we may ask you for additional information, such as your PayPal email address, location (city/state/country only), your personal website and other social media accounts, your education background and the languages you are fluent in.

We do not store any credit card or other payment information from you.

B. Files. We collect and store the files or materials you upload, download, or access with the Services, including profiles you create, pictures you post, files you upload, and other information directly related to your use of the Services or offering of your own services using the Platform ("Files"). If you add a File to the Platform that has been previously uploaded by you or another user, we associate all or a portion of the previous File with your account rather than storing a duplicate.

C. Cookies. We use "cookies" to improve and personalize your experience, provide our services, analyze the Site's performance, and for marketing purposes, as further detailed below. A cookie is a small data file stored on your web browser. We use "session ID cookies" to enable certain features of the Platform, to better understand how you interact with the Platform and to monitor aggregate usage and web traffic routing on the Platform. We also use "persistent cookies" to save your registration ID and login password for future logins to the Platform. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, if you do not accept cookies, or opt-out of the use of cookies, you will not be able to use the Platform at all or certain functionality will be limited.

We use the following types of cookies:

Essential cookies. Cookies that are essential for our Services or Platform to function. They are used to enable core functionality, such as authentication, security, connection stability, etc. You can always set your browser to block or alert you about these cookies, but this may affect how the Site functions.

Analytics cookies. Cookies that help us know which pages are popular and how visitors move around the Site. We use them to count visits, check traffic sources, and measure and improve the Site's performance.

Marketing Cookies. Certain third-party service providers use advertising cookies to identify and store behaviors that users take when visiting our Site in order to provide you with advertising based on your interests and preferences.

D. Log Data. When you use the Platform, we automatically record Information from the device you use, its software, and your activity using the Platform. This includes the device's Internet Protocol ("IP") address, browser type, the web page(s) visited before you came to our Platform, Information you search for on our Platform, locale preferences, identification numbers associated with your devices, your mobile carrier, date and time stamps associated with transactions, system configuration, metadata concerning your Files, and other interactions with the Platform.

E. Third Parties. We process Personal Information that we collect from public sources, such as data that is available on Twitter profiles, from third party vendors and/or from other commercially available sources. We also receive information from advertising and marketing partners in order to manage and measure our campaigns, and if you link, connect, or login to your account with a third-party service (e.g. Google or Twitter), we also receive certain information, such as your registration and profile information from that service. This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.


2. How We Use Your Information

A. Personal Information. We use Personal Information: (i) to provide and improve our Platform, Services and customer service, (ii) to administer your use of the Platform and Services, (iii) to better understand your needs and interests, (iv) to personalize and improve your experience, (v) to provide or offer Platform updates and product announcements; (vi) to contact you as requested by you or required to provide our Platform and Services, (vii) to promote and advertise our Platform and Services, including by sending you direct marketing communications about our products or promotions that may be of interest to you, you have the right to prevent direct marketing of any form at any time - this can be exercised by following the opt-out link attached to each communication or by sending an email to support@clearvoice.com(viii) to protect the rights of our employees, users, suppliers, business partners, and our own rights, (ix) to enforce our legal terms for using the Platform and Services, (x) to take any action in any case of dispute, or legal proceeding, (xi) to prevent and remediate fraud, misappropriation, infringements, identity theft, cyber-attacks and other illegal activities and misuse of the Platform or Services, (xii) to comply with any applicable law including requests and orders of law enforcement agencies and authorities, and (xiii) for any other purpose with your consent.

B. Files. Files are stored with a cloud storage service and be accessed and downloaded by you. We do not access or use your Files other than in aggregated reports that do not contain, nor that can be used to extract, Personal Information.

C. Aggregated Information. Aggregated data is not identifiable. We use the standard analytics tools of Google Analytics, Segment, and HubSpot and we will use additional or other analytics tools, from time to time. The privacy practices of these tools are subject to their own privacy policies.

D. Analytics. We also collect and use some Personal Information (ourselves or by using third party services) using logging, cookies and similar tracking technologies, such as IP addresses, which can sometimes be correlated with Personal Information. We use this Information for the above purposes and to monitor and analyze use of the Platform and Services, for the Platform's technical administration, to increase our Platform's and Services' functionality and user-friendliness, and to verify users have the authorization needed for the Platform and Services to process their requests.


3. Information Sharing and Disclosure

A. Information you share with other users and Site visitors. We will display your Personal Information in your profile page according to the preferences you set in your profile or in the Platform. You can review and revise your profile Information at any time. When you publish your Personal Information and/or share your data with other users, you do so at your own risk.

B. Service Providers, Business Partners and Others. We do not sell your Personal Information, Files or other information about you to third parties. We use certain trusted third-party companies and individuals to help us provide, analyze, and improve the Platform and the Services (including data storage, maintenance services, database management, web analytics, payment processing, and improvement of the Platform's and Services' features). These third parties have access to your Personal Information only for purposes of performing these limited tasks on our behalf and under obligations similar to those in our terms of use. We use industry standard storage service to store your Files and other Information. We also share your Personal Information with third parties, such as social networks, for the above purposes and to offer you additional services or products.

C. Integrations. We allow third party integrators ("Integrators") to create applications and/or tools that supplement or enhance the Platform and Services (the "Integrations"). If you choose to access any such Integrations, the Integrators will access (via API or other methods) and use information you provide solely for the purpose of supplementing or enhancing the Platform and the Services through the Integrations.

D. Compliance with Laws and Law Enforcement Requests; Protection of Our Rights. We disclose to outside parties Files and Personal Information stored in the Platform and Personal Information about you that we collect when we have a good faith belief that disclosure is reasonably necessary to (a) comply with a law, regulation or compulsory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse of us, our Platform or Services or our users; or (d) to protect our or third party property rights and to respond to claims against us. If we provide your Files to a law enforcement agency as set forth above, we will remove our encryption from the Files before providing them to law enforcement. However, we will not be able to access and decrypt any Files on your behalf or that you encrypted prior to storing them via the Services. Such disclosure or access may occur if we have a good faith belief that we are legally compelled to do so, or that disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing.

E. Transfers of Our Business. If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your Personal Information will be transferred as part of that transaction.

F. Related Entities. We share your Personal Information with our corporate affiliates that are related by common control for the purposes listed herein.

G. Aggregated Data. We disclose aggregated data at our discretion, such as in connection with the usage statistics of our Platform and Services.

International Data Transfers

We may host, store, process, maintain or transfer Personal Information to various sites worldwide, outside your jurisdiction including through cloud based service providers, where data protection laws may not be as protective as those in your jurisdiction. By using the Services or the Platform, you hereby acknowledge that you read and understand that we may transfer Personal Information to countries outside your jurisdiction or country. Where specific laws or regulations relating to data transfer apply to us, we will endeavor to ensure that the Personal Information is protected and transferred in a manner consistent with legal requirements.


4. Our Retention of Your Personal Information

A. Data Retention. We retain and use your Personal Information as necessary to fulfill the purposes of using such information under this Policy, to provide you our Services, to comply with our legal obligations, resolve disputes, and enforce our agreements.

We will keep aggregated data without limitation. Subject to our discretion, and in accordance with applicable law, we will delete or de-identify potentially identifiable information, when we no longer need to process the information in an identifiable form.

Consistent with these requirements, we will delete your Personal Information upon request. Please note, however, that there might be latency in deleting Personal Information from our servers and backed-up versions might exist after deletion.

B. Changing or Deleting Your Information. If you are registered as the account holder, you may review, update, correct or delete the Personal Information provided in your registration or account profile by changing the "account settings", all in accordance with applicable law. In some cases, we retain copies of your Personal Information and Files if required by law. When you ask us to exercise any of your rights under this Policy and applicable law, we may need to ask you to provide us certain information to make sure that you are who you claim you are, to avoid disclosure to you of Personal Information which is related to others that you are not authorized to receive, and to ask you questions to better understand the nature and scope of Information that you request to access. For questions about your Personal Information or Files on our Platform or Services, please contact us using the information provided below. We will respond to your inquiry within 30 days. If you no longer wish to receive communications from us, please follow the "unsubscribe" instructions provided in any of those communications, or update your account settings, as applicable.


5. Our Protection of Your Personal Information.

A. Encryption. When you enter sensitive Personal Information (such as a social security number) on our order forms and when you add or upload Files, we encrypt the transmission of that Personal Information using secure socket layer (SSL) technology.

B. Security. We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. No method of electronic transmission or storage is 100% secure, however. Therefore, we cannot guarantee its absolute security. If you have any questions about security on our Platform or Services, you can contact us through the contact information provided below.


6. Age Restrictions

A. By entering into this Policy, you acknowledge and agree that you are at least eighteen (18) years of age and that this Policy forms a binding, enforceable agreement between you and us.

B. Our Platform and Services are not directed to persons under 18years of age. We do not knowingly collect Personal Information from children under 18 years of age. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us through the contact information provided below. If we become aware that a child under 18 years of age has provided us with Personal Information, we will take steps to delete such Information.


7. Specific Provisions for California Residents

This section applies solely to all visitors, users and others who reside in the State of California. We adopted this section to comply with the California Consumer Privacy Act of 2018 ("CCPA") and any terms defined in the CCPA have the same meaning when used in this section.

We have collected the Personal Information which is described above under the section "The Personal Information We Collect and Store" of this Policy from Consumers within the last twelve (12) months. Such Information consists of the following categories:

  • Identifiers and Personal Information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), and your photos, if uploaded by you.
  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a Consumer's interaction with the Site.
  • Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Geolocation data, namely your physical location or movements.
  • Inferences drawn from any of the above-mentioned information.

We obtain the categories of Personal Information listed above from the following categories of sources:

  1. Directly and indirectly from you and your activity on the Site.
  2. Third parties such as reliable service providers and social networks.

We use the Personal Information we collect or receive for the purposes mentioned under the section "How We Use Your Personal Information" of this Policy.

We disclose Personal Information to third parties for Business Purposes as described above under the section titled "Information Sharing and Disclosure".

In the preceding twelve (12) months, we have disclosed all the categories of Personal Information detailed above for Business Purposes to all the categories of third parties.

In the preceding twelve (12) months, We have not sold Personal Information.

Your rights as a California Resident

In addition to your rights under the section titled "Our Retention of Your Information", if you are a California resident, you are entitled also to the following specific rights under the CCPA regarding Personal Information related to you:

  • Access to specific Personal Information and data portability rights - you have the right to request that we will disclose certain information to you about our collection and use of Personal Information related to you over the past 12 months. Upon verification of your request, we will disclose to you:
    • The categories of Personal Information we collected about you;
    • The categories of sources for the Personal Information we collected about you;
    • Our Business or Commercial Purpose for collecting that Personal Information;
    • The categories of Personal Information that we disclosed for a Business purpose, and the categories of third parties with whom we disclosed that particular category of Personal Information;
    • The specific pieces of Personal Information that we collected about you;
    • If we disclosed Personal Information related to you for a Business Purpose, we will provide you with a list which will identify the Personal Information categories that each category of recipient obtained.
  • Deletion rights - you have the right to request that we delete any of Personal Information related to you. Upon confirmation of your request, we will delete (and direct our Service Providers to delete) Personal Information related to you from our records, unless an exception applies.
  • Non-discrimination - you also have a right not to be discriminated against for exercising your rights under the CCPA.

Exercising Your Rights

To exercise the access, data portability, and deletion rights described above, please submit your request to us by sending an email message to: support@clearvoice.com

Only you or a person authorized to act on your behalf, may make a request related to Personal Information related to you.

A request for access can be made by you only twice within a 12-month period.

The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with the requested Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. We will only use the Personal Information provided in your request to verify your identity or authority to make the request.

We will do our best to respond to your request within 30 days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will inform you of the reasons for such decision and provide you with a cost estimate before completing your request.


8. Do Not Track

Most web browsers and some mobile operating systems and mobile applications include a Do Not Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this policy.


9. Third Party Links

Please note that our Site contains links to third party sites and if you link to a third party site from the Site, any data you provide to that site and any use of that data by the third party are not under the control of ClearVoice and are not subject to this Policy. You should consult the privacy policies of each site you visit. This Policy applies solely to Personal Information collected by our Site. If you upload content, including Personal Information, to a social network and then tag the Site, your submission will be subject to that social network's terms of use and privacy policy, even where you post on an official ClearVoice page on the social network. We do not have control over these terms of use and privacy policies and have not reviewed their adequacy. You should therefore review these before submitting any Personal Information.


10. Changes to this Privacy Policy

This Policy may change from time to time; any changes we make to this Policy will be posted on this Site, we will also take any other steps, to the extent required by applicable law, including notifying you about material changes. Changes to this Policy are effective as of the stated "Last Updated" date. Your continued use of the Services or the Platform after we post such notice constitutes your agreement to any such changes. We recommend that you check the Policy periodically for any updates or changes.
